Request: Request 1: Consider a patient who was in receipt of Income-related Employment and Support Allowance (ESA), but has had their benefit stopped following a re-assessment. If the patient appeals the benefit decision, may they claim free prescriptions/dental treatment/etc on the basis of their ESA claim for the duration of their appeal? Bearing in mind that during a benefit appeal, a) the patient may have zero income, b) the patient's benefit payments may be reinstated, but this can be at the discretion of the DWP (the patient may have to take his pot luck as to whether or not this actually happens), and c) if/when the patient wins his appeal, the benefits will be reinstated in full payments will be made retrospectively, and hence he may retrospectively be eligible for free NHS services. I would be grateful for any information you may have regarding this matter. Request 2: Regarding NHS penalty charges; how many penalty charges have you pursued through the courts in the years 2016, 2017, and so far in 2018?
