Request: Dear Team Re:Complaint [customer reference redacted] -Appeal I am making a complaint to the relevant department and I would also like to request the following information as part of a freedom of information request from your team. The details I require relate to Section 3 (g) (ii) of The National Health Service (Penalty Charge) Regulations 1999 listed below. I would be grateful if you could send me the following; Number of appeals received regarding NHS Dental exemptions from 01 November 2017 to date; Number of rejected appeals regarding NHS Dental exemptions from 01 November 2017 to date; Number of cancellations issued for Dental Penalty Charges since 01 November 2017 to date; Reason for cancellations issued for Dental Penalty Charges since 01 November 2017 to date; Number of cancellations completed using Section 3 (g) (ii) below from 01 November 2017 to date; Number of complaints received by the Complaints commissioner and cancelled since November 2017. Section 3 (g) (ii) of the Act that a person is not liable by virtue of a penalty notice— (i) to pay at any time so much of any amount referred to in section 122B(1)(a) or (b) of the Act for which he is jointly and severally liable with another as at that time has been paid, or ordered by a court to be paid, by that other(2), or (ii) to a penalty charge, or a surcharge, if he shows that he did not act wrongfully, or with any lack of care, in respect of the amount recoverable as mentioned in section 122B(1)(a) or (b) of the Act(3).
