Request: Given your client's position is that the Mini Competition was compliant with all legal obligations and properly identified the successful bidder, GAMA requires confirmation as to how the proposed re-run will address our client's concerns. Our client incurs considerable time and cost in responding to call off competitions under the Framework Agreement, in particular when the process requires legal proceedings to be issued to protect its rights. In order for our client to have confidence in any re-run, please provide the following information in advance of any re-run being commenced: 3.1 The steps that were taken to investigate our client's concerns as set out in our letter dated 19 October 2017; 3.2 The outcomes of that investigation; 3.3 What requirements of the ITMC your client considers are 'clear' but were interpreted in different ways by bidders (we must assume that this is what happened in light of your most recent letter); 3.4 The basis on which your client considers that it conducted the evaluation in accordance with the requirements of the ITMC that led to it properly identifying the successful bidder; 3.5 The amendments that will be made to the next Invitation to Mini Competition to ensure that the issues that arose in this Mini Competition are addressed.
